    i think he has a fair complaint, but i think Sony is in a spot, paying him out may set a precedence, and while our disabled south aussie friend here only wants 800 bucks the yanks probably want 800 million each

    I really don't think he has a leg to stand on.
    The update was optional; and they've basically covered themselves with disclaimers from day 1 (including about 4 just to use the updates).

    It's not actually optional, because if you don't update your firmware, you can't access the PlayStation Network anymore.

    The class action lawsuit in the US has good traction. Sony could be in the shitter with this one.

    Reading that I think he has good ground to stand on. He bought it with the advertised abilities of installing another OS and using the PS Network as long as he updated. Now he has to choose which is NOT what he agreed to when he bought it. I'd be pissed off too.

    Pretty sure it's also a breach of the trade practices act.
    Its the reason why all such agreements include a disclaimer regarding exception when prohibit by local law.
    Yes he should be entitled to a full refund.

    Like it was mentioned before, he's only after a reasonable amount with actual thought going into the end amount, not just a greedy american after millions.
