Bennett was driving the box truck that Shelton rear-ended on the Southwest Freeway near Kirby around 2 a.m.

Not really. If as the drunk chick alleges that the truck driver swerved into her lane, then she is correct in suing him as the crash would have occurred regardless of her intoxication levels.

Assuming she's telling the truth of course :p

Ermm.. What?

For that to happen she must have been going really, really fast and he must have been going at a snails pace - she killed her boyfriend in the crash... remember? If the US is anything like Australia with its road rules, most rear-endings are the fault of the driver that rear-ended.

I find it very hard to believe it could be the truck drivers fault and I think you're just picking an argument for the sake of it.

I also find it unlikely that it was the truck drivers fault...I'm just pointing out that there is a possibility that the driver is suing on valid grounds.

Could the truck driver say he swerved becuase of a deer that no one else saw, would they still be able to sue then?

you drink and drive you lose all rights to complain about other poeples driving.

Either way she hit the truck, was drunk, bff's dead, she was driving - she should be thankful that she only spent 4 months in the big house. Fuggin seppos!!!

OMG let me guess the truck was parked no lights on was driving and the truck didnt have its lights on and she ran into it.

no. you are not supposed to swerve for wildlife (to hit or to avoid)

She should be thrown back in Jail because clearly she hasn't learned anything
