this is the 2nd time they have done this.

i called at 5 past 9, and they said

Phone Girl: "We sold out within 10 minutes of opening"
Me: "What time did you open?"
Her: "9 o'clock"
Me: "umm. it's 5 past 9"
Her: "umm.. we've sold out"

end of phone call!

well, i don't know about you, but this seems like a huge pile of crap. :P

You can actually report this in to the ACCC. Has been done recently to Supercheap for a similar thing, and they had to send out a bunch of vouchers.

yeah it seems a bit dodgy, maybe just a marketing ploy to get ppl in the store - why doesnt anyone else have them for 99 bucks?

it's more the line of they sold out in the first ten minutes, when they had only been open 5.

Actually there is something about "Reasonable Supply" or some shit like that. Basically if you have a special like that you have to have adecent amount of stock to sell.

Case with Supercheap, they had to cough up basically.

So basically get more people complaining.

By way of background it may be appropriate to outline briefly the role of the ACCC and the scope of the Trade Practices Act 1974 (Cth) (TPA). The main purpose of the TPA is to promote competition and efficiency in markets within Australia which is achieved by prohibiting prescribed anti-competitive conduct and providing for consumer protection.

While I cannot provide legal advice I can advise that section 52 of the TPA prohibits corporations in trade or commerce from engaging in misleading or deceptive conduct or conduct that is likely to mislead or deceive. Section 56 prohibits corporations from engaging in the practice of ‘bait advertising’. That is, businesses are prohibited from advertising products at a particular price if there are reasonable grounds for believing they will not be able to offer those goods at that price for the period, in quantities that are reasonable. What is reasonable will depend on the particular circumstances, including the market in which the goods are sold and the nature of the advertisement. The conduct that you describe may be at risk of breaching this provision of the TPA. For this reason I have lodged details of your complaint in our national database.

The information obtained from individual complainants is used to establish a pattern of behaviour by a particular trader or in a particular industry. The ACCC’s consumer protection focus is on national issues and those localised issues that have wider public interest implications. The ACCC would usually pursue this type of complaint only where there is significant detriment, generally evidenced either by the number of complaints it receives and/or the magnitude of any loss suffered by consumers. At this stage the ACCC is not in a position to confirm what, if any, action may be taken on this matter. However, in the meantime this information will be used in the context of our ongoing monitoring.

That was Repco not Supercheap. They advertised car audio gear with prices of "000 being slashed to $200, etc. and most stores only had 1 or 2 in stock which the staff promptly bought.. many had none.. big thread on OCAU.

I know literally 9 people that wanted to buy one, and called around (or drove to) a range of JB stores here in Sydney, 4 in total, hours apart, and they were all sold out.

They did try to up-sell my friends to the $249 pack though, which came with 3 games or something. Totally dodgey.

tell them to lodge a complaint with the ACCC.. they will possibly wnd up with a "00 voucher.

selling an ebox "mother inlaws wording ebox" for $99 is so cheap you could use it as toilet paper,

if you know anyone who works at jb hi fi in cas i suggest you use them to find out how much stock they had at the time of sale if they have a good stock system you should be able to get a print off from the program as evidence :)

Yep I'm real sure they'd be keen to incriminate their employer and risk losing their job...

Kmart are selling Xbox's for $80. It might only be this one Kmart at Burwood here in NSW, but if there's one near you it's probably worth checking out.

i spoke with a friend who works at jb hi fi cas

and he told me because they are discontinue item "its while stocks last, basically what they have in the store room thats it " there is a lil thing in there terms an conditions about discontinued items going cheap

I got a call from the ACCC today as I had lodged a complaint.
They said it would go on their registar of companies to watch or something like that and that they will follow it up etc. I think that they will coz they had to call me 3 times to get me at a time i could talk to them. They said something about reasonable supply.

well the repco one, i dont know how many complaints.. but the ACCC investigated and they had to provide everyone who complained in writing to repco or the accc with a "00 in store voucher... for basically the same conduct.
