Well today here I am deliverying a pizza to a house and this girl comes out..
So far nothing abnormal.
Then to my right some dood comes running out saying ?? "Who the F*$% is this guy. And with that WACK dood runs up and punches me in the head.
Jumps on top and smacks me again, I turn and grab him, kick him once then some dood from across the road comes and pulls him off of me.
FUK DAT.
Turns out that they had been broken up for 3 weeks and he thought I was the new man.. REAL bad pains in my ribs, ahh well he is getting charged for assault .. And I get my just deserves ...
Hey i learnt a cool thing about being beaten up by gangs, what you do is say 6 people mob you, instead of trying to fend off all of them focus all your attention on one bloke and beat the living shit out of him so hard he either dies or has to be taken to hospital, after they kick the shit out of you, tell the police and that you busted one bloke up enough he needs to go to hospital, there bam you got one person unless he is a maschoist and enjoys pain.
Welcome to the real world man. Though the guy must have been an idiot to go to you who was probably carrying a pizza. ^o^
Seriously though, bad luck, but it could have been worse. I'd been in a few situations where a customer wanted to thump me, but I usually just stand up straight (I usually slouch a little) and they wimp out... On the other hand the number of half naked 70 year old blokes asking me to 'come in and have a drink' when dropping off the pizza's was not a nice thing. ~_~

but you get like cash yeah? and the guy's in jail or something.. Now you just have to get the girl, let him beat you up again and sue - second time after being charged :P = more money.. rinse and repeat
yep it stinks for murder they should be hung or shot or anything else that kills em for rape cut of there willy for stealing cut off a finger its simple easy and it will reduce the crime for sure
nah but i think this one will be in a physco ward because he was smoking to much weed. i mean usually you dont go around bashing people in a pizza uniform unless there is something wrong with you, and he showed unseen a mull plant, just after he bashed him or something, so im thinking thats what did it.
The dood has been processed , the police officer who was looking after me came to my work to check that I was ok .. Yeah the guy will be in court in a few weeks and yeah should be all sorted after that
Quote from Harbinger: [quote:11eba8af87="Heretic"]at least now the dude where he should be. in a jail cell.
bahahhaha this is darwin, you can kill people and get a suspended sentence[/quote:11eba8af87]
"Don't blame me", begins a phrase with some currency in Darwin, "I voted CLP".
That said, it's not that simple. The NT News have a marvellously flexible method for presenting the facts, viz:
Do the facts, honestly and completely presented, make people angry or sickened? If yes, flog 'em front page. If no, chop crap out until they do.
Quote from Harbinger: "you beat this woman to death, you're a monster!!!!!, 10 years, parole in 5"
In the NT, a full murder charge, subject to legal defenses, attracts a life sentence without parole. Manslaughter can attract 10 to life, and dangerous act leading to death can attract up to 10 (14, if you're intoxicated).
Our assailant here will probably be charged with assault, and possibly dangerous act leading to bodily harm. If he was stoned he'll get additional time. But the sentencing on assault is more flexible for judges.
Remember, though: for every big problem, there is answer which is simple, popular, and wrong.
Quote from Milenko: also good to see im not the only one posting at 3am on christmas day :p
We've already opened all our presents. "Sod youse all". Had the family over and we had a fondue, with proper F-U Kirsch made by a Swiss family. No alcohol rating, but I reckon you could run a car with it. Mind you we were supposed to have a Raclette, but the machine is b0rken.
It's cool being in an Australian-Seychelloise-Swiss-Dutch family.
Yeh my best mate and his family are all swiss. Went there for a kick arse dinner and to open all the pressies tonight :) I could tell you what i had for tea, but i cant pronounce any of the fkn names :p
Yep Coco told me all about it Unseen I didn't believe him at first but hay shit happens & the dickhead will be charged good job. But I'm sure the NT gov have got something in placed called crime victims compensation or something like that, you get money but it depends how much it affected you. Just say you can't sleep at nights & get chest pains all the time when you breathe. You should at least put in a claim form cuz I heard some one got nearly about "000 compensation for getting bashed.
But no ones wants to get bashed in the first place even for "000 sif Unless you are disparate & really need that sound card. lol
Quote from Unseen: this is the first time in Dominoes history in Darwin that this has happened.
its not an every day occurence
lol I'm glad to hear it.. I start on Sunday cause they needed drivers really bad out here in Palmo. The pay seems pretty good.. how much do you earn Unseen?
May have a better job coming up in a few weeks though :) Really hope I get it.

This arises because of the old distinction between civil and criminal wrongs in the law. In a civil case, you drag the person into court and you sue them for damages. This is still possible: you can still sue an attacker for some form of monetary compensation, although in some jurisdictions any criminal case removes the option of a civil case. I'm not sure which way the NT goes on it.
I don't think that trying to import some kind of mutant hybrid between insurance and civil damages into the criminal law will be a good idea in the long run. It might have been better to go the other way, and go "Icelandic":
Yeah what about OJ Simson.. he was found not guilty (or whatever) in a criminal court.. and then his wifes parents took him to a civil court and he was found guilty.. that is just plain screwed up.
Quote from Imitation: Yeah what about OJ Simson.. he was found not guilty (or whatever) in a criminal court.. and then his wifes parents took him to a civil court and he was found guilty.. that is just plain screwed up.
Welcome to the American Inquisitorial system where the judges and lawyers are trained by television. :P

Actually it makes good sense.
In a criminal trial, the accused faces a deprivation of their liberty. This is a very serious matter, not one to be taken likely. Therefore the law demands of people who make accusations that they must prove them beyond "all reasonable doubt". Otherwise it'd be too easy to get your enemies locked up, and civil society and liberty would suffer as a result. In OJ Simpson's criminal trial, there was a lot of evidence linking him to the murder, but there were also gaps and flaws. The jury decided that there was a reasonable possibility - not necessarily a big one, but it was there - that OJ didn't commit the crime. Since they were not completely convinced of his guilt, OJ's presumed innocence stood and he was freed.
In a civil trial, the burden of proof is lighter and more evenly spread between the parties. No longer must the accuser prove every accusation beyond reasonable doubt. Some claims must be proved by the accuser, and some disproved by the accused - and the decision is to be made on the balance of evidence. That is, whoever's case seems most likely to be true. Thus, while there were still problems with the accuser's case, it was found to be more likely that OJ had committed the murder than not.
Because civil cases are more lax, they cannot lead to criminal sanctions, ie, the deprivation of liberty. Instead the family of OJ's wife were awarded damages expressed financially. OJ was fined.
Of course in some legal systems (such as the medieval icelandic system discussed in my link above) are purely civil: all crimes against you lead to civil action. Most interesting of all about the icelandic system was that you could sell your right to sue someone who'd wronged you. The poor could sell their case to a person who could afford to pursue it, meaning that the state was completely unnecessary in enforcing criminal sanctions. It's a good article, go read it. :)
